At long last, the West Virginia Bureau of Health’s Office of Medical Cannabis (“OMC”) is now accepting permit applications for medical cannabis growers, processors, dispensaries and laboratories. The hard deadline to submit applications is February 18, 2020 at 3 pm, right in time for happy hour. The applications first became available on December 19, 2019. The OMC can issue up to 10 grower licenses, 10 processor licenses and 100 dispensary licenses. An individual can hold interest in one processor permit, one grower permit and up to ten dispensary permits. Each application requires a non-refundable fee – $2,500 for dispensary applications, $5,000 for grower and processor applications. West Virginia allows for vertical integration, meaning an individual applicant can win all 3 permits. This initial round of permit licensing for West Virginia promises to be competitive. Applicants should consult with a cannabis industry consultant or attorney to ensure that their applications are complete.
