Kinner & McGowan assists New York attorney with a win in Federal Court

Kinner & McGowan, acting as local counsel and Gary Greenberg, a New York attorney representing plaintiff Zvi Shtauber, received a favorable decision from US District Court Judge John Bates.  Dr. Shtauber, an Israeli national and former Israeli Ambassador to the United Kingdom sued prominent D.C. Attorney Allen Gerson for breach of contract among other claims. Gerson filed a Motion to Dismiss, claiming that the contract between him and Shtauber violated the rules of professional ethics for attorneys and as such was contrary to public policy.  Judge Bates’s disagreed, ruling that even though the contract violated professional ethics, D.C. Courts have shown flexibility where refusing to enforce such a contract would result in a windfall for one party.  Check out the article in Court House News below:
